Abstract

Based on the essay by M. Cristina Seghesso de López, “El primer ciclo del poder constituyente provincial. Variantes federales y planteo orgánico del
poder en debate”, I offer an overall interpretation of the provincial constitutions sanctioned between 1819 and 1852. I will consider the series of constitutions
as a textual corpus to analyze the constitutional codified discourse in a particular moment of transition. My analysis deepens one of Seghesso’s
arguments, according to which these texts were marked by a duality of powers derived from the hypothetical configuration of a higher instance that appears
as a constant throughout the whole period.
